CONTRACT OF LEASE

 

KNOW ALL MEN BY THESE PRESENTS:

 

            This agreement made and executed at Tanauan City, Batangas this ___ day of ________________ by and between:

 

            SPOUSES MARIO C. GAYTANO and YOLANDA A. GAYTANO, both of legal age, Filipinos, with address at Ve Denhaag, The Netherlands and with domicile at Talisay, Batangas, and herein after referred to as LESSORS;

 

and

 

            FAMILY CHURCH, a religious corporation duly organized and existing under Philippine law and herein represented by JUAN DELA CRUZ, Filipino, of legal age, married and with address at Lipa City, Batangas,  herein referred to as LESSEE;

 

            WHEREAS, the LESSORS are the owners of a commercial space situated at Brgy. Bunga, Talisay, Batangas covered by Transfer Certificate of Title with No. T-xxxxxx12;

 

            WHEREAS, the LESSEE desires to renew the lease the above-stated property and the LESSORS agreed thereto, subject to terms and conditions herein below set forth:

 

            NOW, THEREFORE, the LESSORS and the LESSEE agree as follows:

 

1.)    TERMS:  This renewal of the CONTRACT OF LEASE shall be for a period of two (2) years from January 6, 2022 until January 6, 2024. This contract may still be renewed upon further negotiations between both parties. Otherwise this Contract of Lease shall terminate on the date of terms stipulated herein;

 

2.)    PURPOSE: The LESSEE shall use the leased premises exclusively as worship venue. The premises shall not be used for any illegal and immoral purpose and shall be compliant to all the laws, acts and ordinances in effect in the Republic of the Philippines;

 

3.)    RENTALS:  The rental for the leased premises is TWENTY THOUSAND PESOS (Php20,000.00) Philippine currency per month. The payment shall be every 6th of the month;

 

The LESSORS shall allow the LESSEE to use the six (6) wooden chairs and three (3) wooden tables owned by the LESSORS. In case the LESSORS shall be needing the said furniture, the LESSEE shall return the same to the LESSORS. That the LESSEE shall be responsible for any damage for the use of the said furniture and appliances within the lease period.

 

The LESSEE shall be allowed to use the space at the back of the building A (leased premises) as their parking area within the lease period;

4.)    DEPOSIT:  The LESSEE shall maintain the one(1) month advance, one(1) month deposit previously paid to the LESSORS in the amount equivalent to FORTY THOUSAND PESOS(P40,000.00). The same remains not refundable. In case this lease shall not be renewed, the one(1) month advance payment shall be consumed by the LESSEE for the last month occupancy/used of the premises. Moreover, the one(1) month deposit payment shall be allotted for the payment of the utilities consumed by the LESSEE for the last month stay in the premises;

 

5.)    CHARGES:  The LESSEE shall pay all water, gas, light, power services and all other utilities such as telephone and cable TV supplied to the leased premises for the duration of this CONTRACT;

 

6.)    ALTERATION & IMPROVEMENT:  The LESSEE shall not make any alterations, modification or improvements in the leased premises without the prior consent of the LESSORS.  Any addition, alteration or modification on the leased premises shall be restored by the LESSEE upon the expiration of this CONTRACT at the sole account of the LESSEE; 

 

7.)    MINOR/MAJOR REPAIRS:  That the LESSEE, shall  keep the leased premises in good habitable condition at all times, making all the necessary minor repairs therein like changing busted lights, and fixing leaking faucets.  On the other hand, the LESSOR shall be responsible for all major repairs on the water, electrical, sewerage installation and structural defects of the leased premises caused by ordinary wear and tear;

 

8.)    SUBLEASE OF ASSIGNMENTS:  The LESSEE shall not assign nor sublease the premises hereby leased without the written consent of the LESSOR and any breach of this condition shall be ground for the termination of this CONTRACT at the option of the LESSOR;

 

9.)    ACCESS AT REASONABLE HOURS:  The LESSEE  shall allow the LESSOR or the latter’s duly authorized agents to enter the leased premises at reasonable hours  for the purpose of inspecting or repairing the same;

 

10.)           ACTS OF FAMILY/EMPLOYEES AND CUSTOMERS:  The LESSEE  shall be responsible for all the acts and omissions of his/her family/employees or customers, domestic servants, agent and other persons which were allowed access to the leased premises or any parts thereof by the LESSEE;

 

11.)           PRETERMINATION OF CONTRACT: The LESSORS have the option to terminate this contract if the LESSEE violates any of the terms and condition stipulated herein. The LESSEE shall turnover the leased premises in good condition to the LESSORS upon termination of this contract;

 

    A written notice of the pretermination/termination of contract shall be given by EITHER PARTY at least THIRTY (30) DAYS prior to the end of the contract.

 

12.)           NOTICE AND APPROVAL OF TERMS:  The parties have read and understood all the terms, conditions and stipulations of this CONTRACT OF LEASE and hereby further agree that the same be binding upon, apply and shall ensure to the benefit of the heirs, administrators or assigns respectively of LESSORS and LESSEE.
